Agreement between REEferralNet and Members.
You acknowledge and agree that by subscribing to and using REEferralNet as a member, you are entering into a legally binding agreement (the "Agreement") with REEferralNet located at 16616 Jackson Street, Omaha, NE 68118 (the "Company", "we", "our", or "us"). By becoming a Member, you acknowledge that you have read and understood these terms and conditions and that you agree to be bound by all aspects of this Agreement, both in letter and in spirit, and held responsible for any violations thereof.
This statement supersedes any prior representations or agreements, whether oral or written. If any section of these terms is found to be unenforceable either in law or in practice, the rest of the Agreement in its entirety will remain in effect. The unenforceable provision will be modified to render it enforceable and effective to the maximum extent possible, in accordance with its intention. The Company's failure to enforce the Agreement does not constitute a waiver of the Agreement.
If you are using the REEferralNet.com website as a representative for another company, that organization may have a separate agreement with us. However, as an individual Member, you are bound by this Agreement regardless of any other agreements the Company may have entered into.
If you do not want to become a Member, do not click Register, submit any information, or view any of the REEferralNet content or web pages.
REEferralNet reserves the right to modify the Terms of Participation at any time and without prior notice to its Members. We may add to, change, delete, or end our or your use of our service at any time. The service may be temporarily unavailable for maintenance or other reasons.
We intend to use such information to support you as a Member by designing website content suitable to your needs and by alerting you to new product and service offerings as they become available. This Member Information may be retained by REEferralNet to verify compliance with the Agreement between REEferralNet and our Members, to keep track of the domains from which people visit us, and to create a user profile to serve you better.
If you decide that we should not use your personal Member Information to contact you, please let us know, and we will not use that information for such a purpose. However, please do not submit any Member Information if you are less than 18 years of age.
As a Member of REEferralNet and REEferralNet.com, I agree to vet all referring Trusted Service Providers that I submit and post to my Trusted Service Providers Directory, and to ensure they can and will act credibly and professionally before adding them to my Trusted Service Providers Directory.
I also agree that I will be granted permission from all Trusted Service Providers before submitting and posting them in my REEferralNet.com Trusted Service Providers Directory. I also agree to comply with all REEferralNet Terms of Use Policy and Procedures.
I agree to hold REEferralNet and REEferralNet.com harmless for all causes, effects, and actions as they may pertain to any cause, and for all actions of the referring Trusted Service Providers that I have added and included in my Trusted Service Providers Directory.
REEferralNet and REEferralNet.com do not sell, trade, or transfer Member Information to third parties. However, we may share Member Information with our business partners for marketing, advertising, or product or service offerings. For example, we provide Member Information to our service providers for the direct emailing of our newsletters, online surveys, or notifications about new REEferralNet offerings to our Members.
We also may disclose Member Information if we have your consent, need to share it to provide you with the products and services you requested, respond to a court order, or determine that you violate our Terms of Use. You may separately agree to provide your personal information to third parties that provide content for REEferralNet Member Offerings. If you agree to provide such information to these third parties, then your personal information will be subject to their privacy policies.
REEferralNet and REEferralNet.com cannot and do not control participants' behavior on REEferralNet.com. We do not assume responsibility for the content or context of user comments and will not remove or edit postings to the public comment areas once they are entered into the service, except to expire records or in our sole discretion.
REEferralNet and REEferralNet.com may be used only for lawful purposes. Transmission, distribution, or storage of material or conduct in violation of any applicable local, state, federal, or foreign law or regulation is prohibited. This includes unauthorized use of material protected by patent, copyright, trademark, or other intellectual property right; material that is obscene, defamatory, or libelous; material that constitutes an illegal threat; material that violates rights of privacy or publicity; or material that violates export control laws.
Use of the REEferralNet website constitutes the grant of a license, not a transfer of title, and under this license you may not:
REEferralNet and REEferralNet.com prohibit the transmission, distribution, or posting of unwanted or offensive content. Prohibited transmissions include, without limitation, profane or sexually explicit language, masked or misspelled profanity, or images that would be illegal in any jurisdiction.
Additional prohibitions include URLs or hyperlinks within a posting or image, pyramid or chain letters, fraudulent or criminal offers, any posting with the goal of harassing another person, sexual requests from or for a minor, racial slurs or comments, harassment, unsolicited advertising, and unsolicited email or advertisements including adult or dating services. REEferralNet and REEferralNet.com also prohibit the transmission, distribution, or posting of any matter that discloses personal or private information concerning any person or entity, including phone numbers, addresses, financial information, and home contact details.
REEferralNet strongly opposes spam, which floods the Internet with unwanted, unsolicited emails and degrades the performance and availability of the REEferralNet.com service. All forms of spam and all activities that have the effect of facilitating spam are strictly prohibited.
If REEferralNet determines in its sole discretion that a violation of the Terms of Participation has occurred, REEferralNet may pursue any of its legal remedies, including immediate deletion of offending material, cancellation of your account and Membership, and exclusion of any person who may have violated these terms. REEferralNet may cooperate with any investigation by any federal, state, or local body, court, or tribunal legitimately exercising its rights, with or without notice to you.
REEferralNet reserves the right to refuse service to anyone at any time and to remove any listings or advertisements for any reason, without notice.
The owners, staff, and our partners are not liable for damages, claims, complaints, regulatory actions, or disputes from a Member's disclosure, misrepresentation, public discussion, or improper reliance on the content of the REEferralNet.com website. Members assume full responsibility for their conduct in using or disclosing content.
Disclaimer of Warranties. You agree that the use of the service is at the Member's sole risk. The service is provided on an "as is" and on an "as available" basis. REEferralNet.com expressly disclaims all warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
REEferralNet makes no warranty that the service will meet Member requirements, that the service will be uninterrupted, timely, secure, or error-free, nor does it make any warranty as to the results that may be obtained from the use of the service or as to the accuracy or reliability of any information obtained from the service.
Limitation of Liability. User agrees that neither REEferralNet.com nor any of its providers of information shall be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use or the inability to use the service, resulting from goods, data, information, or services purchased or obtained, messages received, transactions entered into, unauthorized access to transmissions or data, or any other matter relating to the service, even if REEferralNet.com has been advised of the possibility of such damages.
In summary, in no event shall REEferralNet or REEferralNet.com be liable to you for damages, losses, and causes of action exceeding the amount paid by you to REEferralNet.com, if any, that is related to the cause of action.
REEferralNet and REEferralNet.com provide links to other third-party websites. Even if the third party is affiliated with REEferralNet through a business partnership or otherwise, REEferralNet is not responsible for the privacy policies, practices, or content of such external links.
